6/24/2002 The Nebraska Supreme Court ruled telephone horse wagering unconstitutional. On 1992, a law passed by the Legislature approved telephone horse wagering. Last Friday the Nebraska Supreme Court sided with Attorney General Don Stenberg who challenged the law, claiming it was not in use for years. Telephone horse wagering was announced unconstitutional. The consequences of such ruling may affect the horse tracks, as they are forced to compete with other wagering channels within the state (i.e. lottery) and outside (casinos). Yet, this system made up only a small portion of the overall betting. All in all, tracks would comply with the decision. On earlier arguments, Assistant Attorney General Jay Bartel quoted the pari-mutuel betting amandment from 1934: "the wagering which may be allowed ... is limited to wagering that takes place inside the confines of a racetrack." Mike Lehan, who represented the race tracks has opposed by comparing telephone wagering to calling a friend on the track asking them to place a bet. Although disappointed by the desicion he stated that naturaly they will abied by that. |
